QRKY Graphical QR Code API — Terms of Service

Please read these Terms of Service ("Terms") carefully before using the QRKY Graphical QR Code API ("the API" / "the Service"). By accessing or using the API, you agree to be bound by these Terms.

1. Acceptance of Terms

By subscribing to the API, generating an API key, or making any API call, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the API.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the API for your personal or business purposes. QR codes generated through the API may be used freely for your intended purposes.

3. API Usage & Rate Limits

Your access to the API is subject to the usage limits and rate limits of your subscription tier. You agree not to:

• Exceed or attempt to circumvent your plan's rate limits or monthly call quota
• Share, resell, or redistribute your API key
• Use the API in a manner that degrades service for other users
• Reverse-engineer, decompile, or attempt to extract the source code of the API

4. User Content

You retain ownership of any images, photos, or other content ("User Content") that you upload via the API. By uploading User Content, you grant us a limited license to process your content solely for the purpose of generating QR codes as requested.

4.1 Content Restrictions

You agree not to upload content that:

• Infringes on any third party's intellectual property rights
• Contains illegal, harmful, or offensive material
• Violates any applicable laws or regulations
• Contains malware or malicious code

5. Privacy

Your use of the API is also governed by our Privacy Policy. We process uploaded images temporarily for QR code generation and do not permanently store your images unless you explicitly save them to your account.

6. Intellectual Property

The API, including its design, features, and functionality, is owned by QRKY and is protected by copyright, trademark, and other intellectual property laws.

7. Disclaimer of Warranties

THE API IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE API WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE API.

9. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Your continued use of the API after any changes indicates your acceptance of the modified Terms.

10. Termination

We may terminate or suspend your access to the API at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
